Filing of Trademarks in Oman:
1. NATIONAL REGISTRATIONS : Only for the territory of Oman.

For a mark to be registrable, it should be able to identify and distinguish the applicant’s goods and services from those of the others.
It is highly advisable to conduct a search of the proposed mark to ensure that a similar mark has not been applied for by other contenders and is not pending registration or is already registered.
Filing is done with the Trademark office of Oman.

Once the application is filed, a Preliminary (Formality) examination regarding compliance of all the requisites is carried out along with a search for prior existing trademarks.
Applicant as to make necessary changes, amendments if any within stipulated time post examination. Else, application is deemed as not filed.
Once the mark is examined regarding registrability. Mark is accepted and are published in the official gazette and 1 local Arabic newspaper. Interested people may file opposition within 2 months from the date of publication to the same.
In the absence of opposition, the published mark is registered and certificate of registration issued.
Usage before filing an application for registration is not a pre-requisite. However, non-use continuously for 5 yrs. post registration would make the mark vulnerable for cancellation.
