The Intellectual Property Rights Office of Mayanmar is the Yangon Registration Office of the Settlements, Land Records Department.
It is pertinent to note that Myanmar does not have Trademark Law. However, a strong conventional practice is in place along with Direction No.13 of the Registration Act No. 16, 1908 which is currently being followed.
Following is general information pertaing to Registrability of marks:
Official trademark search is unavailable at the Registry. However, a private search based on newspaper clippings based on Cautionary Notices published in leading English dailies are conducted.
Filing is done with the Registry. Following documents are required for registration:
ii Power of Attorney
iii Declaration of Ownership which is a solemn statement of facts made by the trademark owner.
• Infringement & Opposition Actions
• License and Assignment procedures
• Trademark Watch Services
Along with filing, the conventional practice is to lodge a Cautionary Notice which is required to be published in a leading local English daily.
Once the trademark application is in compliance with all the requisites, it proceeds with the registration.
Renewal and Re-Publication of the trademark is optional though a repeat every 3 yrs. is advisable.
Such Renewal and Re-Publication of Cautionary Notice gives better rights to the trademark along with boosting trade advertising and commercial activity.
